PACKAGE TOUR SALES AGREEMENT

SUBJECT OF THE AGREEMENT:

This agreement covers the mutual rights and obligations of the parties regarding the sale and performance of domestic/international package tour holiday services, the characteristics, sales price and conditions of which are specified in the annex to the agreement. CONTRACT PRICE AND PAYMENT TERMS:
Article 1 – Subject and Scope of the Contract
This contract covers the mutual rights and obligations of the parties regarding the sale and performance of domestic and/or international package tour services announced by the agency.
The content, duration, sales price, payment terms, and services included in the tour price are detailed in the tour brochures, tour program, and/or registration (reservation) documents.
Services not included in the tour price include extra food and beverages purchased by the participant outside the scope of the package tour, personal expenses, transportation and services not explicitly stated in the program, and all goods and services outside the program.
Unless explicitly stated otherwise, visa and passport procedures and service fees, museum and archaeological site entrance fees, and services provided by third parties and not separately mentioned in the promotional materials are not included in the tour price.
The realization of the tour is subject to the condition of reaching the minimum number of participants specified in the program or promotional materials. If the minimum number of participants is not reached, the agency reserves the right to cancel the tour.

Article 2 – Contract Price and Payment Terms
The participant is obligated to pay the full tour price no later than before the tour departure date, in accordance with the payment schedule notified by the agency.
Payments can be made via bank transfer/EFT to the agency's bank accounts, by credit card, or in cash against a receipt.
If the full tour price is not paid within the specified period, the agency reserves the right to cancel or suspend the reservation without further notice to the participant. Any cancellation and cancellation fees that may arise in this case will be applied in accordance with the provisions of Annex 1 Cancellation and Refund Conditions.
In the case of payments made by credit card, the agency cannot be held responsible for any provisioning, installment, or payment confirmation problems arising from the bank, payment institution, or cardholder. In such cases, the payment is only considered valid on the date it is actually transferred to the agency's account. TERMINATION, CANCELLATION AND POSTPONEMENT OF THE AGREEMENT
Article 3 – Termination, Cancellation and Postponement of the Agreement
The agency has the right to cancel or postpone the tour if, despite having exercised all due diligence, circumstances arise that prevent the tour from starting or make it impossible to conduct the tour successfully;
such as failure to reach the required number of participants, adverse weather conditions, road closures, strikes, terrorism, fog, the possibility of war, unforeseen technical issues, and force majeure, as well as other reasons not attributable to the agency. In such cases, the agency cannot be held responsible for any damages that may arise from the cancellation or improper performance of the contract.
In case of tour cancellation; the amounts collected from the participants, excluding mandatory taxes, fees and insurance costs, and service fees that cannot be refunded by third parties, will be refunded within a maximum of 14 (fourteen) days following the notification of cancellation to the participant. In case of tour postponement; The participant will be notified of the new date and may accept or decline to participate in the tour on the announced date. In this case, refund conditions will be applied in accordance with Appendix 1 Cancellation and Refund Conditions.

Article 4 – Termination of the Contract by the Consumer
The consumer may unilaterally terminate the contract by notifying the agency in writing or via a permanent data storage medium (email, WhatsApp, SMS, etc.). In case of termination by the consumer; cancellation, withdrawal and refund conditions shall be applied in accordance with the provisions set out in Annex-1 “Cancellation and Refund Conditions” document, which is an integral part of this contract. Date changes requested by the consumer shall be considered as termination/cancellation and the relevant transactions shall be carried out according to the provisions of Annex-1.
Article 5 – General Provisions
The participant accepts that all responsibility regarding their luggage and its contents belongs to them, and that they are obliged to comply with the legal regulations and customs applicable to the means of transportation they will travel in and the accommodation facilities they will stay in. The participant is responsible for monitoring and controlling their belongings and personal items. The agency and its employees are not liable, either legally or criminally, for any items lost, stolen, or damaged during the tour. The participant is obligated to comply with the rules communicated by the guide, facility, agency, and transportation vehicle authorities to ensure the smooth running of the purchased service. In case of non-compliance with these rules and/or actions that endanger the life and property of third parties, the agency has the right to discontinue the tour service, remove the participant from the tour, or take necessary administrative measures. In such cases, the participant's partial or complete inability to use the tour does not entitle them to a refund. The participant accepts and undertakes not to make any claims against the agency or its employees for these reasons.
The participant is responsible for carrying money, jewelry, valuable documents, and similar valuable items in their luggage. The agency cannot be held responsible for the loss or damage of such items.
Article 6 – Visa and Passport Procedures
Visa and passport procedures are the responsibility of the participant. Guests participating in international tours may be offered consultancy services regarding the visa application process upon request. This includes information and guidance on the necessary documents for a correct visa application. Reservations (hotel, flight, ferry, etc.) and confirmations are provided by the agency under the "Services Included in the Tour" and forwarded to the relevant authority handling visa procedures. The agency does not directly intervene in the visa application process. Visa procedures are entirely at the discretion of the relevant consulates and official authorities, and the agency does not guarantee that a visa will be obtained. Obtaining a visa does not guarantee entry to the country. The agency bears no responsibility for any consequences arising from the denial of entry. Cancellation and refund procedures arising from the inability to obtain a visa or being denied entry will be evaluated in accordance with the provisions of Annex 1, Cancellation and Refund Conditions, which are an integral part of this agreement. The participant declares that they are aware of and accept these terms and conditions while participating in the tour. Article 7 – Transportation Methods, Schedules and Trip Changes
Departure times and trip information for transportation methods such as airplanes, ferries, trains, buses, etc., are determined in accordance with the information provided by the carrier companies on the date the contract is drawn up.
The agency is not responsible for any changes that carrier companies may make to departure times, number of trips, routes, and schedules. Such changes may occur before or during the tour.
The participant is obliged to check the departure locations and times of the transportation methods to be used within the scope of the tour in accordance with the information provided by the agency before the tour and to act in accordance with this information.
If the participant is unable to participate in the transportation or is delayed due to reasons attributable to them (being late, being in the wrong place, not adhering to the stated times, etc.), the agency has no responsibility or obligation to refund for any failure to participate in all or part of the tour. In this case, the participant is responsible for any additional transportation expenses required for participation in the tour.

Article 8 – Insurance and Coverage Scope
In case the package tour is not provided incompletely or at all; in accordance with Article 12 of the Travel Agencies and Travel Agencies Association Law No. 1618, mandatory package tour insurance has been taken out by the agency.
This insurance covers situations where the services promised to be provided within the scope of the package tour are not provided incompletely or at all, and the coverage amount is limited to the package tour price.
The participant may, at their own expense, take out travel health insurance, personal accident insurance, or additional insurance with cancellation coverage against accidents, illnesses, and similar risks before the start of the package tour and/or accommodation service.
Such optional insurances are independent of the package tour insurance offered by the agency; the scope of insurance, coverage amounts, and conditions are subject to the policy provisions of the relevant insurance company.
Article 9 – Authorized Authority and Enforcement
In case of disputes arising from the application and interpretation of this contract; The Marmaris Enforcement Offices and Courts are authorized, subject to the consumer's legal rights arising from the Law No. 6502 on Consumer Protection.
The consumer declares that they have read and are aware of all the preliminary information regarding the characteristics of the product and/or service subject to the contract, the sales price, the payment method, information regarding performance, and all matters included in the promotional brochure and tour program.
This contract, together with the Cancellation and Refund Conditions in Appendix 1, consists of a total of … (……) articles; it has been read, understood and accepted by the parties and signed in two copies, and entered into force on … / … / ….

APPENDIX 1 - CANCELLATION AND REFUND CONDITIONS
DOMESTIC PACKAGE TOURS (by plane):
• For cancellations made 30 days or more before the start of the tour; Except for mandatory taxes, fees, insurance costs, and non-refundable service fees charged by third parties, the amount paid will be refunded without deduction. • For cancellations made 29-20 days before the start of the tour, a 25% cancellation fee will be charged. • For cancellations made 19-14 days before the start of the tour, a 50% cancellation fee will be charged. • For cancellations made 13-7 days before the start of the tour, a 75% cancellation fee will be charged. • For cancellations made 6 days or less before the start of the tour, a cancellation fee of up to the full tour price may be charged, along with non-refundable costs related to airfare, accommodation, and other services. NOTE: Scope of Tour Price and Separately Shown Items
The tour price refers to the main services offered within the scope of the package tour.

Services INCLUDED in the tour price:
• Accommodation services as specified in the program
• Transportation services (plane/bus/transfer) as specified in the program
• Guiding services
• Sightseeing tours and activities as specified in the program
• Agency organization service fee
Items NOT INCLUDED in the tour price and shown separately:
• Mandatory taxes and fees (airport taxes, airport and terminal usage fees, legal transportation taxes, etc.)
• Mandatory package tour insurance fee
• Non-refundable service fees provided by third parties (non-refundable or penalty air tickets, non-refundable hotel fees, carrier and supplier penalties)
• Visa, service, and similar official payments, if any
• Optional tours and extra services specified separately in the program
These items are fees transferred to third parties and institutions and are subject to the refund rules of the relevant institutions in case of cancellation and are evaluated independently of the tour price.

DOMESTIC PACKAGE TOURS (by bus):
• For cancellations made 30 days or more before the start of the tour; the amount paid will be refunded in full, excluding mandatory taxes, fees, insurance costs, and non-refundable service fees charged by third parties. • For cancellations made 29–15 days before the start of the tour, a 30% cancellation fee will be charged. • For cancellations made 14–7 days before the start of the tour, a 60% cancellation fee will be charged. • For cancellations made 6 days or less before the start of the tour; a cancellation fee of up to the full tour price may be charged, along with non-refundable costs related to accommodation, transportation, and other services. INTERNATIONAL PACKAGE TOURS:
• For cancellations made 30 days or more before the start of the tour; Except for mandatory taxes, fees, insurance costs, visa fees, and non-refundable service charges by third parties, the amount paid will be refunded without deduction. • For cancellations made 29-20 days before the start of the tour, a 30% cancellation fee will be charged. • For cancellations made 19-14 days before the start of the tour, a 60% cancellation fee will be charged. • For cancellations made 13-7 days before the start of the tour, a 90% cancellation fee will be charged. • For cancellations made 6 days or less before the start of the tour, a cancellation fee of up to the full tour price may be charged, along with non-refundable costs related to airfare, accommodation, visa, and other services.

GENERAL INFORMATION AND TERMS:
1. Participant Change (Transfer / Name Change)
In case of a definitive cancellation, the participant may request to be replaced by another participant. This request will be evaluated in accordance with the nature of the tour and the rules of the carrier and supplier.
Name changes in air tickets, ferry tickets and similar transportation services are subject to the practices of the carrier companies. Additional costs that may arise due to the name change will be passed on to the participant. If no costs arise due to the carrier company's practices, the name change will be made free of charge.
2. Use of Cancellation Fee in Another Tour
In case of cancellation, the participant may request that the amount paid be used in another tour. Such requests will be evaluated by the agency, taking into account criteria such as the agency's operational situation, whether the tour is by plane or bus, the number of people sold, and the vehicle and accommodation organization. Acceptance of these requests is at the agency's discretion and does not automatically create a right for each request. 3. Health Problem or Death
In the event that the participant or their immediate family member (mother, father, spouse, child) experiences a serious health problem or passes away during the tour dates:
• This situation must be documented with an official health report or death certificate obtained from a fully equipped state hospital. • The documents must be submitted to the agency before the start of the tour. If these conditions are met:
• Excluding mandatory taxes, fees, insurance costs, and service fees that cannot be refunded by third parties,
• refund amounts that can be actually collected from hotels, airlines, local operators, and other suppliers will be refunded to the participant from the date they reach the agency. In international package tours, since the refund processes of hotels, airlines, and other international suppliers may take a long time or there may be a possibility of no refund, the agency is not obligated to pay the refund amount in advance or to act on behalf of the supplier. The refund process is completed depending on the practices of the relevant supplier and carrier companies, and the agency cannot be held responsible for delays that occur outside of the agency's control. 4. Health Issues or Death During the Tour
If a health problem or death occurs after the start of the tour;
• The participant or their relative is obliged to notify the agency with supporting documentation within 1 (one) day at the latest. • After the agency informs the relevant suppliers (hotel, airline, local operator, etc.), any refund amounts that can be obtained from the suppliers will be refunded to the participant. • The agency is not responsible for amounts that cannot be refunded by the suppliers.

5. Supplier Rules and Operational Limitations
Most of the transportation, accommodation, and other services offered within the scope of the tour are provided by third parties and institutions. Therefore, cancellation, change, and refund procedures are applied in accordance with the rules of the relevant supplier and carrier companies. The agency has no obligation to make refunds outside of the supplier rules.
6. No-Show, Late Arrival, and Early Departure
In the event that the participant is not present at the meeting point specified at the start time of the tour (no-show), joins the tour late, or leaves the tour early at their own request;
• The participant's failure to use the tour at all or partial use does not entitle them to a refund. • In these cases, the agency has no obligation to refund for unused services. • Any additional transportation, accommodation, or other expenses that may arise are the responsibility of the participant.
7. Right to Change the Program
The agency reserves the right to make changes to the program due to weather conditions, road conditions, force majeure, decisions of local authorities, or operational necessities (in air tours - changes in flight schedules by the airline, etc.);
• We reserve the right to make changes to the following:
• The order of visits included in the tour program,
• Accommodation facilities (provided they are of the same category or higher),
• Transportation times and routes. Such changes do not give rise to a right of cancellation or refund unless they disrupt the integrity of the tour.
8. Information and Notification Channels
The participant is responsible for the accuracy of the contact information (telephone, e-mail, etc.) provided during the reservation process. Information provided by the agency through these channels is considered official notification. 9. Good Faith, Operational Evaluation and Customer Satisfaction Approach
Our agency adopts a service approach based on the principles of honesty, transparency and customer satisfaction in all its activities. Every tour and every participant is carefully evaluated individually and holistically in line with this approach.

Tour organizations; Depending on the nature of the tour, destination, number of participants, operational conditions, supplier structure, and seasonal peaks, each tour may present different challenges or ease of access. In this context, the feasibility of fulfilling requests from participants will be evaluated in accordance with the operational capabilities and actual conditions of the relevant tour. While the provisions in this contract and the related cancellation and refund conditions are binding and fundamental rules for the parties, the agency may, at its discretion, provide support to the participant in good faith to prevent any hardship, provided that this does not create any rights, constitute an acquired right, or set a precedent, taking into account the participant's situation, the accuracy of the statements, the specific conditions of the tour, and the available operational capabilities. Such good faith practices are entirely at the agency's discretion and do not constitute a general practice, a continuous, automatic obligation, or a binding precedent for similar requests.
